WOODLAKE CITY COUNCIL        MINUTES      JUNE 28, 2010       6:30 P.M.

PRESENT:  Councilmembers Martinez, G. Gonzalez Jr. Mendoza, R. Gonzalez  and Ortiz
OTHERS:    Gonzalez, Lewis, Watson, Zapalac and Dominguez

CONSENT CALENDAR

(a) Approval of the Minutes of the regular meeting held on June 14, 2010.
(b) Approval of the Warrants in the amount of  $231,462.63.
MOVED BY COUNCILMEMBER MARTINEZ, SECONDED BY COUNCILMEMBER G. GONZALEZ TO APPROVE THE CONSENT CALENDAR.  APPROVED WITH COUNCILMEMBER ORTIZ ABSTAINING.

SCHEDULED MATTERS     

1. Discussion/Action – Approval of Plans and Specifications and authorize Staff to bid the  Waste Water Treatment facility project.  Mr. Dominguez stated the award of Bids would take place sometime in September or October. Eco Logic Engineers were available to answer questions.
MOVED BY COUNCILMEMBER ORTIZ, SECONDED BY COUNCILMEMBER MARTINEZ TO APPROVE THE PLANS AND SPECIFICATION AND AUTHORIZE STAFF TO BID THE PROJECT.  APPROVED UNANIMOUSLY.

2. Discussion/Action – Woodlake Fire District update on revenues pass through from the City of Woodlake to the District.  Attorney Pat Sullivan stated the Fire District contract with the City expires on June 30, 2010 and the District voted to renew the agreement for a period of time until they work out details with the County to receive the County fire tax revenue and have them do their booking. The District contacted the Tax Collector and they confirm that the 1986/87 county fire revenue was $21,005.  City Attorney stated no agreement is necessary from the City.

3. Discussion/Action – Approval to re-appoint Jack Ritchie to serve as Woodlake representative on the Measure R Citizens Advisory Committee (CAC).
MOVED BY COUNCILMEMBER R. GONZALES, SECONDED BY COUNCILMEMBER MENDOZA TO APPROVE THE RE-APPOINTMENT OF JACK RITCHIE TO THE MEASURE R CITIZENS ADVISORY COMMITTEE.  APPROVED UNANIMOUSLY.

4 Discussion/Action – Adoption of Ordinance No. 576 amending the Woodlake Zoning Ordinance, reclassifying approximately 70.76 acres from Tulare County’s AE-20 (County) to the ML (limited industrial zone District).
MOVED BY COUNCILMEMBER MARTINEZ, SECONDED BY COUNCILMEMBER G. GONZALEZ TO ADOPT ORDINANCE 576, WAIVE READING.  APPROVED UNANIMOUSLY.

5. Discussion/Action – Approval to appropriate $30,000 of gas tax funds, from the 2010-11 budget, to fund the Wutchumna Ave. reconstruction project (design only) 800’ west of Castle Rock.  City Administrator stated upon completion of the design Staff will bring this item back to the Council for discussion.



MOVED BY COUNCILMEMBER MENDOZA, SECONDED BY COUNCILMEMBER ORTIZ TO APPROPRIATE $30,000 FROM THE 2010-11 GAS TAX FUND FOR THE WUTCHUMNA AVE. PROJECT DESIGN.  APPROVED UNANIMOUSLY.

6. Discussion/Action – Approval of Resolution 10-18 setting the City of Woodlake’s appropriation limit for fiscal year 2010-11. City Administrator stated that the 2010- 11-appropriation limit is $1,832,900.
MOVED BY COUNCILMEMBER ORTIZ, SECONDED BY COUNCILMEMBER
G. GONZALEZ TO APPROVE RESOLUTION 10-18. APPROVE UNANIMOUSLY.

7. Discussion/Action – Approval of Resolution 10-19 approving an application to the California State Department of Housing and Community Development for funding under the Cal Home program.  City Administrator stated the Grant amount of $1,000,000 is for both Owner Occupied Rehabilitation and Mortgage Assistance activities.
MOVED BY COUNCILMEMBER ORTIZ, SECONDED BY COUNCILMEMBER MARTINEZ TO APPROVE RESOLUTION 10-19.  APPROVED UNANIMOUSLY.

8. Discussion/Action – Resolution 10-20 amending the Conflict of Interest Code to Incorporate by reference the Fair Political Practices Commission Standards.

G. GONZALEZ TO APPROVE RESOLUTION 10-20.  APPROVED UNANIMOUSLY.

REPORTS

Chief Zapalac - stated it been quiet in town, the Explorer’s have returned from Pebble Beach and a helicopter was called in to help locate a suspect.
City Clerk – stated that Fatima Alsumiri has moved and her Plaque for participating as Woodlake High School Student Representative will be mailed to her. Councilmember G. Gonzalez stated he would contact the other Student who was interested in the program to see if she would consider participating in September.
City Administrator - invited the Council to the Transit needs meeting at Valencia House at 4:00 p.m.
Councilmember Mendoza stated that Paul Santana, EDC President asked to give an update at the July 12th meeting. Also, he reported on the City of Delano spray park, which was  $90,000 and funded by the CDBG program. He stated he notice on the Police Report that several break-ins occurred during the hours of 6:a.m. – 10:00 a.m. He asked what we could do to support the Police Department and inform the Residents. Chief Zapalac stated we have Neighborhood Watch programs and we need to attend the meetings and contact our watch Captains.
Councilmember Martinez – asked what type of Playground equipment were we going to put on the lot at Mountain View Ave. Dominguez stated they are working on the Design for the park. He though a ½ Basketball court might work with smaller equipment inside the park.
Councilmember G. Gonzalez - stated that the July 3rd firework show will start at 5:00 p.m. and the fireworks at 8:30 p.m. Games, food and water activities will be provided and tickets can be purchased at City hall.
Mayor R. Gonzales asked about the Parcel map for the City Park and what the status was regarding signs and graffiti. City Attorney stated abandoned signs could legally be removed.

PUBLIC COMMENTS - Public Comments was reopen by the Mayor.

Brian Rouch – candidate for Tulare County 4th district stated he wanted to attend the meeting to learn about Woodlake and stated that he was raised south of Ivanhoe, does farming and he is a 6th generation in Tulare County.
His concerns were Public safety, jobs, and he stated that he would like to see the Cities and County have a better partnership. He thanked Woodlake resident that helped with his campaign and stated he would work well in the Community.
